Release of Liability Agreement

Effective Date: 1-1-2025

This Release of Liability ("Agreement") is entered into by and between Silver Birch Engraving Co. ("Company") and the undersigned customer ("Customer"). By signing this agreement or completing the online form, the Customer acknowledges and agrees to the following terms:

1. Services and Risks

  • The Customer understands and agrees that the engraving, marking, or customization services performed by the Company on Customer-provided items may involve risks, including, but not limited to, accidental damage, discoloration, or unintended alterations to the item.
  • The Customer acknowledges that the Company will take all reasonable precautions to protect the item but cannot guarantee perfect results due to the unique properties of each material.

2. Customer Responsibilities

  • The Customer affirms that all items submitted for engraving or customization are legally owned by them and are free of restrictions for modification.
  • The Customer is responsible for ensuring that the item is suitable for the requested engraving or customization and that all details provided for the service (e.g., spelling, dates, or design elements) are accurate and complete.

3. Limitation of Liability

  • The Company shall not be held liable for:
    • Any damage resulting from defects in the Customer-provided item or incompatibility with the requested service.
    • Loss of value or sentimental worth of the item.
  • The Customer agrees to hold the Company harmless from any claims, damages, or losses arising from the engraving or customization process, except in cases of gross negligence or willful misconduct by the Company.

4. Refunds and Replacements

  • The Company does not offer refunds or replacements for Customer-provided items that are damaged during the engraving or customization process unless the damage is due to gross negligence or willful misconduct by the Company.
  • Refunds or replacements for Company-provided products are subject to the Company's Shipping and Returns Policy.

5. Agreement and Waiver

  • By signing this Agreement or completing the online form, the Customer voluntarily assumes all risks associated with the engraving or customization services.
  • The Customer releases and forever discharges the Company, its owners, employees, and agents from any liability or claims related to the services performed, except as provided by law.

6. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

Acknowledgment and Agreement

By signing below or submitting this form electronically, the Customer acknowledges that they have read, understood, and agreed to the terms outlined in this Release of Liability.
